Forex trading in Indonesia is legally recognized as a form of commodity futures trading under Law No. 32 of 1997, and is supervised by the Commodity Futures Trading Regulatory Agency (BAPPEBTI) of the Ministry of Trade. All retail and institutional forex transactions must be conducted through brokers registered with BAPPEBTI to ensure compliance with national standards of transparency and investor protection (1).
In addition to BAPPEBTI’s oversight, Bank Indonesia regulates the operational framework for foreign exchange transactions between domestic banks and clients. Under Bank Indonesia Regulation No. 18/18/PBI/2016, spot and derivative forex transactions are subject to thresholds, underlying transaction requirements, and strict prudential measures to maintain market stability and integrity (2).
“Dalam rangka upaya mempercepat pengembangan dan pendalaman pasar keuangan, perlu dilakukan pengayaan variasi instrumen pasar valuta asing domestik untuk dapat menjadi alternatif bagi pelaku pasar dalam melakukan lindung nilai, sekaligus mendorong pengembangan infrastruktur, dan peningkatan kredibilitas pasar.” (2)
To participate in the legal forex market, traders must open accounts with BAPPEBTI-licensed futures brokers, adhere to minimum transaction thresholds, and comply with reporting and risk-management requirements. Licensed brokers are required to segregate client funds and disclose all fees and trading conditions in accordance with BAPPEBTI regulations (1).
Although forex trading is legal under these regulatory frameworks, prospective traders should verify the registration status of their chosen broker via the BAPPEBTI registry and stay informed of policy updates from both BAPPEBTI and Bank Indonesia.
