Forex trading is legal in Curaçao and operates under a comprehensive regulatory framework administered by the Central Bank of Curaçao and Sint Maarten. The most important objectives of the CBCS are to maintain the external stability of the Netherlands Antillean Guilder and to promote the efficient functioning of the financial system (2). The Central Bank supervises banking and credit institutions, manages foreign exchange reserves, conducts monetary policy, and regulates foreign exchange transactions under the National Ordinance on Foreign Exchange Transactions (2).
The CBCS implemented a revised Foreign Exchange Regulation on October 1, 2024, designed to reduce administrative burden and accelerate the granting of foreign exchange licenses. The transaction limit triggering the need for a foreign exchange license increased from NAf. 150,000 to NAf. 500,000, significantly reducing the number of transactions requiring a license (1). Personal transfers to foreign bank accounts now only require a license for amounts exceeding NAf. 500,000 per year, compared to the previous threshold of NAf. 250,000 annually (1).

Securities intermediaries and investment managers operating forex trading platforms must obtain licensing from the CBCS under the National Ordinance on the Supervision of Securities Intermediaries and Investment Managers. The CBCS remains committed to maintaining stringent anti-money laundering and combating the financing of terrorism measures, with all applications for foreign exchange licenses or exemptions subject to rigorous integrity checks including identification requirements, sanction screening, and document submissions for legal entities (1). The Central Bank monitors compliance with AML/CFT regulations including FATF recommendations (2).
