Forex trading is legal in The Bahamas under the regulatory oversight of the Securities Commission of The Bahamas. Established in 1995, the Commission is responsible for regulating and overseeing investment funds, securities, financial and corporate service providers, digital assets and registered exchanges, carbon credit trading, and the capital markets in The Bahamas (1). The Commission utilizes market surveillance, regulatory oversight, enforcement of securities laws and its investor education program to protect investors, maintain fair, efficient and transparent markets, and reduce systemic risk.
The Bahamas maintains a fixed exchange rate policy which pegs the Bahamian dollar one-to-one with the U.S. dollar, and the government ensures adequate foreign exchange to support the fixed rate parity (2). Individuals and corporations residing in The Bahamas are subject to capital or exchange controls which govern all foreign currency transactions between residents and non-residents. However, exchange controls are not considered an impediment to foreign investment, as the government allows non-resident investors to finance their projects via foreign currency transfers and to convert and repatriate profits freely.

The Commission's functions include maintaining surveillance over financial markets, fostering timely and accurate disclosure of information to the public, and protecting the integrity of financial markets against abuses arising from financial crime and market misconduct (1). All non-resident investors in The Bahamas are required to register with the Central Bank, and this has been done with minimal bureaucratic formalities and without limitations on the inflows or outflows of funds for legitimate forex transactions.
