Forex trading is legal in Antigua and Barbuda, where the international financial services sector operates under the regulatory oversight of the Financial Services Regulatory Commission (FSRC). The FSRC was established in 2002 to regulate and supervise financial services business carried on in or from within the country, including various financial activities such as international banking, insurance, and securities operations (1). Since Antigua and Barbuda is a member of the Eastern Caribbean Currency Union, certain forex activities also fall under regional regulatory frameworks that aim to protect investors and maintain market integrity.
The Eastern Caribbean Securities Regulatory Commission (ECSRC) plays a significant role in safeguarding the regional securities market by protecting investors from unfair and fraudulent practices. The member countries of the ECCU include Anguilla, Antigua and Barbuda, The Commonwealth of Dominica, Grenada, Montserrat, Saint Christopher and Nevis, Saint Lucia, and Saint Vincent and the Grenadines (2). The ECSRC regulates securities business across these territories under uniform securities legislation, primarily the Securities Act 2001 and its amendments.
"The primary functions of the Commission are to maintain the integrity of the Eastern Caribbean Securities Market; protect investors; promote market efficiency; and facilitate market development."
While forex trading itself is permissible in Antigua and Barbuda, investors must exercise caution regarding unauthorised forex trading schemes. The ECSRC has issued warnings about fraudulent forex trading scams that offer high returns and guaranteed profits through managed accounts or trading platforms (2). These unauthorized operations violate legal requirements by evading proper licensing and authorisation procedures, putting investors at significant risk.
